Scope of application  

The General Terms and Conditions of Production Resource Group AG (PRG Switzerland) apply to all legal relationships between the parties, subject to written agreements.   

  

Subject of the rental  

The subject of the rental is the equipment listed on the delivery note, including accessories and small material. The lessee shall inspect the rental object upon handover and claim any defects immediately, otherwise the rental object shall be deemed to be in perfect condition.   

  

Use of the rental object  

The leased property may only be used by the lessee by suitable and capable operating personnel for the intended purpose and with due care. The lessee shall strictly comply with the operating instructions and safety regulations. The rental object shall be kept in a locked or guarded environment during the entire rental period. If the rental object is to be used outdoors, the hirer is obliged to provide protection against the effects of the weather, in particular against moisture and wetness.  

  

Ownership   

Ownership of the rental object including accessories and small materials shall remain with the lessor.   

Only what is expressly designated as such shall be deemed to be consumables.   

  

Rental period   

Unless expressly agreed otherwise, the rental period shall be measured in days and shall be based on the agreed period of surrender. The minimum rental period is one day.   

  

Cancellation  

In the event of cancellation of an agreed rental, the Lessee shall owe PRG liquidated damages without proof of loss and subject to the assertion of further damages in accordance with the following rates:   

Cancellation up to 30 days before the start of the rental period: 50% of the total rental amount.  

Cancellation up to 8 days before the start of the rental period: 75% of the total rental amount  

Cancellation up to 7 days before the start of the rental period: 100% of the total rental amount.  

  

Concessions, permits etc.   

The lessee shall be responsible for obtaining all necessary permits, concessions, licences and similar and shall bear all associated costs. If the leased property is confiscated or a lien is placed on it due to breaches by the lessee in this respect, the lessee shall be fully liable to pay damages to PRG.   

  

Liability of the Lessee   

The Renter shall be liable for any damage to or defect in the rented item which was not reported at the time of takeover. He shall also be liable for loss or destruction of the leased property. In such cases, the Lessee shall owe PRG not only the full replacement or restoration value but also any further damage incurred by the Lessor.   

  

Repair and Maintenance  

Any maintenance or repair work required on the Rental Goods during the Rental Period may only be carried out by PRG or a third party designated by PRG.   

  

Return of the leased property 

The leased property must be returned at the agreed time and place. In the event of late return, the Lessee shall be liable for each day that has elapsed in accordance with the daily rates agreed for the rental without proof of damage by the Lessor. The right to claim further damages remains reserved.   

  

Alteration of the rental object   

The lessee is prohibited from making changes to the leased property or having such changes made. In particular, the Lessee is prohibited from covering, altering or removing advertising or company lettering affixed to the leased property by PRG.   

  

Subletting and assignment  

The Lessee is prohibited from assigning the rental relationship to third parties.  

  

Prices and conditions   

The rental price and conditions shall be determined in accordance with the offer/cost breakdown/order confirmation. The invoice amounts are due net within 10 days from the date of invoice. Shipping or transport costs shall be borne by the hirer.   

  

Insurance  

It is the hirer’s responsibility to insure the equipment and accessories against all risks at his own expense.   

  

Theft/transport damage  

In the event of theft or loss, the hirer is always obliged to have a police report drawn up. If transport damage is discovered, the hirer must arrange for the carrier to make an inventory.  

  

Applicable law and place of jurisdiction  

Swiss law is applicable in accordance with the Swiss Code of Obligations. The exclusive place of jurisdiction is the registered office of Production Resource Group AG in Wil / ZH.
